Terms of Service

Overview

These Terms of Service ("Terms") govern your access to and use of Pebblechest provided by Pebblechest .

By accessing or using the service, you agree to these Terms. If you do not agree, do not use the service.

Eligibility

You must be at least 13 years old (or the age of digital consent in your country) to use the service. If you are using the service on behalf of an organization, you represent you have authority to bind that organization.

Accounts and security

• You are responsible for your account and maintaining the confidentiality of your credentials.
• You must provide accurate information and keep it up to date.
• We may suspend or terminate accounts for abuse, fraud, or violations of these Terms.

Marketplace role

Pebblechest is a marketplace that helps creators list digital assets and helps buyers discover, purchase, and download those assets. Creators are responsible for their listings, pricing, and the content they provide. We facilitate payments, delivery, and support communications, but we are not responsible for the content of creator assets.

Creator program (invite-only)

Creator onboarding is invite-only. We may accept or decline applications at our discretion and require additional verification. Creators must agree to the Creator Agreement, which supplements these Terms.

User content and licenses

If you upload or create content in the service ("User Content"), you retain ownership of your User Content. You grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and distribute your User Content as needed to operate, promote, and improve the service.

Asset licenses and restrictions

Digital assets are licensed, not sold. Buyers receive a non-exclusive license to use purchased assets in their own projects, subject to any license terms stated on the asset listing.

• No resale, redistribution, or sublicensing of assets as standalone files.
• No claiming authorship or trademark rights in a creator's assets.
• Assets may be modified for use in projects, but may not be used to build competing libraries.

Acceptable use

• Do not attempt to access or disrupt systems you do not own or have permission to use.
• Do not upload malware, infringing content, or illegal material.
• Respect rate limits and security controls.

Payments, fees, and taxes

Payments are processed by Stripe and subject to Stripe's terms. You authorize us to charge your chosen payment method for purchases or subscriptions. Prices and taxes may vary by location.

If you are a creator, we deduct platform fees and any refunds or chargebacks from your earnings before payout.

Refunds

Refunds are governed by our Refund Policy. Digital products are generally non-refundable once downloaded, except where required by law or otherwise stated in the policy.

Digital content withdrawal

If you are in the EU/EEA or UK, you may have a 14-day right of withdrawal for digital content that has not yet been delivered. By checking the box at checkout, you consent to immediate delivery and acknowledge that your withdrawal right ends once the download starts (where applicable).

Creator payouts

Creator payouts are handled through Stripe Connect Express. We initiate payouts on a weekly schedule and do not offer instant payouts. Stripe or banking networks may delay payouts for compliance, risk, or processing reasons.

Copyright

We respond to copyright notices and may remove content or terminate repeat infringers. See our Copyright Policy for details.

Termination

You may stop using the service at any time. We may suspend or terminate access if you violate these Terms or if required for security, legal, or operational reasons.

Disclaimers

The service is provided "as is" without warranties of any kind, to the maximum extent permitted by law.

Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.

Indemnification

You agree to indemnify and hold us harmless from claims, damages, and expenses arising out of your use of the service, your content, or your violation of these Terms.

Governing law

These Terms are governed by the laws of Denmark . Disputes will be handled in Danish courts .
